3. Account Registration

To use PhonePA, you must:

• Be at least 18 years old
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

4. Subscription and Payments

PhonePA operates on a subscription basis:

• Subscriptions are billed monthly in advance
• Voice usage beyond included minutes is billed at the rates shown on our pricing page
• Prices are in GBP and exclusive of VAT where applicable
• We reserve the right to change pricing with 30 days notice
• Refunds are provided at our discretion and in accordance with applicable law

You agree not to use PhonePA to:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Send spam, unsolicited communications, or make nuisance calls
• Transmit malicious software or harmful content
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Impersonate others or misrepresent your identity
• Record calls without appropriate consent where required by law

6. AI Features and Limitations

Our AI assistant is designed to help automate business communications. Please note:

• AI-generated content requires your review and approval before being sent or actioned
• The AI may occasionally make errors or misinterpret information
• You remain responsible for all communications and documents sent on your behalf
• AI capabilities may be updated or modified over time
• Complex or sensitive matters should be handled personally

7. Call Recording and Consent

PhonePA records and transcribes calls to provide its services. You are responsible for:

• Obtaining appropriate consent from call participants where required by law
• Informing callers that calls may be recorded and processed by AI
• Complying with all applicable call recording laws in your jurisdiction
• Configuring appropriate announcements for inbound calls answered by the AI

8. Intellectual Property

The PhonePA service, including its software, design, and branding, is owned by AI Works Lab Limited and protected by intellectual property laws. You retain ownership of your data and content. You grant us a license to use your content as necessary to provide our services.

9. Service Availability

We strive to maintain high service availability but do not guarantee uninterrupted access. We may temporarily suspend the service for maintenance, updates, or circumstances beyond our control. We will endeavor to provide notice of planned maintenance where possible.

10. Limitation of Liability

To the maximum extent permitted by law:

• Our liability is limited to the fees paid by you in the 12 months preceding any claim
• We are not liable for indirect, incidental, or consequential damages
• We are not liable for lost profits, data loss, or business interruption
• We are not responsible for third-party services or integrations

Nothing in these Terms excludes liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

11. Indemnification

You agree to indemnify and hold harmless AI Works Lab Limited and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the service, violation of these Terms, or infringement of any third-party rights.

Either party may terminate this agreement:

• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of your current billing period
• We may suspend or terminate your account for violation of these Terms
• Upon termination, your access to the service will cease
• You may request export of your data within 30 days of termination

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the service. Continued use after changes take effect constitutes acceptance. If you disagree with changes, you may terminate your account.

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
